Information on how to enter form part of the Terms and Conditions. By entering this Promotion, you agree to be bound by these Terms and & Conditions.
Entry is open to New Zealand residents only who either have an Instagram account and are following @huntleyandpalmers. Your Instagram account must be "public" or set to public for the Promotion Period for your entry to be eligible. Employees of Griffin’s Foods Limited (“the Promoter”) and any agencies and companies associated with this Promotion and their immediate families are ineligible to enter.
Only entries complying with these Terms and & Conditions are valid.
The Promotion commences on 9.00am Thursday 24th August 2017 and closes at 4.00pm Monday 28th August 2017 (“Promotion Period”). No entries will be accepted outside of the Promotion Period.
There are three (3) prizes consisting of a food hamper worth $50 each to be awarded at the end of the Promotion Period. Actual prize products may vary and it is at the Promoter's discretion. The Prize will be delivered to a single specified physical address within New Zealand for each winner.
To enter the Promotion, entrants must: (a) Follow @huntleyandpalmers on Instagram (b) Tag another Instagram user in the giveaway post.
Each valid entry, which is valid and complies with entry requirements these Terms & Conditions, will be entered in to the Promotion draw.
The winner will be determined by random draw at the end of the Promotion Period on Tuesday 29th August 2017 and will be notified in accordance with clause 21 of these Terms & Conditions and on the same day within 48 hours. If the winner cannot be contacted within 2 weeks of notification, the prize will be redrawn. In all cases the judge’s Promoter’s decision is final and no correspondence will be entered into.
You may only enter the Promotion once. In the case of multiple entries from the same email address, the first valid entry will be taken into consideration and no others.
The delivery of the Prize will take place within 14 days of the winner’s confirmation that they have received notification of winning the Prize and having supplied a valid New Zealand physical delivery address (excluding PO Boxes) as recognised by the New Zealand postal system.
Entrants that promote violence, threats and illegal acts or publish material containing pornography pornographic, obscene, hate or, racist or other inappropriate material content are inappropriate and will be deemed to be invalid. Entrants that infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible and will be deemed to be invalid. Entrants that are considered as unsolicited electronic commercial messages including overly repetitive messages, or repeatedly raises issues that have previously been addressed or non-consensual advertisement are inappropriate and will be deemed invalid. Any entry and copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter.
Any cost associated with accessing Instagram or Facebook to enter the Promotion is the entrant's responsibility and is dependent on the internet and mobile telephone service provider used.
The winner agrees to be available for reasonable promotional and publicity purposes. This includes, but is not limited to, using the winner's name and image in any way including via the @huntleyandpalmers Instagram page and the Promoter's other social media and websites.
Entries submitted by or through fraud or other illegal activity; or entries not complying with these Terms and & Conditions, are invalid.
The Promoter takes no responsibility for lost, damaged, misdirected, late or illegible entries, incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access telecommunications network services, or any other error or malfunction.
All entries are deemed to be received at the time of receipt by the Promoter's database and not at the time of transmission by the entrant. Records of the Promoter are final and conclusive as to time of receipt.
The Promoter reserves the right to verify the validity of any entry. The Promoter reserves the right to disqualify any entrant who was not eligible to enter, who does not comply with these Terms and & Conditions, who submits inappropriate or offensive material, or tampers with the entry process or attempts to act in a fraudulent or otherwise dishonest manner.
The Promoter's decision on any aspect relating to this Promotion is final and no correspondence will be entered into.
Entrants are identified by the Instagram account used to submit the entry. Any prize won by drawing a winner whose entry was received on the Instagram post will be awarded to the holder of the Instagram account from which entry was submitted. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. The Promoter takes no responsibility for disputes arising as a result of entries submitted by entrants using an Instagram account belonging to any other person.
The winners will be notified by private message to the Instagram account used when the prizes are drawn. This notification will include information on how a prize may be claimed. The winner will also be announced on the Huntley & Palmers Instagram page https://www.instagram.com/huntleyandpalmers.
The Promoter reserves the right to substitute any prize with another prize of similar value without prior notice. The Prize must be taken as offered, may not be deferred, is non-transferable nor exchangeable for cash. The Promoter shall not be liable if, for any reason outside its reasonable control, the Prize or part of the Prize becomes unavailable.
The Promoter accepts no liability for any delay for any reason beyond the Promoter's reasonable control relating to the delivery of the Prize.
Subject to clause 28, the Promoter and its associated agencies and companies will not be liable if the Prize does not reach the winner for reasons beyond the reasonable control of the Promoter and its associated agencies and companies.
If, for any reason beyond the Promoter's reasonable control, the Promotion is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Promoter, and its associated agencies and companies, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, the Promoter reserves the right, at its discretion, to cancel, modify, terminate, suspend, extend or reschedule this Promotion.

Subject to clause 28 and any liability which cannot be excluded by law, the Promoter and its associated agencies and companies shall not be liable in any way (including, without limitation, in negligence) for any loss or damage whatsoever suffered (including, without limitation, indirect or consequential loss) or for any loss or damage or personal injury suffered or sustained or any costs or expenses arising out of or in connection with this Promotion, the Prize or use of the Prize. The Promoter is not liable for any tax implications that may arise as a result of winning the Prize.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantee as provided under the Consumer Guarantees Act 1993.
The Promoter respects privacy rights under the Privacy Act 1993 and is required to comply with the privacy principles in respect of collection of personal information from individuals. The Promoter collects and holds personal information provided with each entry to be used for the purposes of the Promotion (and in particular to notify the prize winner and to verify the prize winner's identity), and for the purpose of future marketing and promotional materials. All personal information provided by entrants will be held by Griffin’s Foods Ltd at Building C, Level 2, Millennium Centre, 600 Great South Rd, Ellerslie, Auckland or such other place as is notified to the entrant on request. You acknowledge that the Promotion is not sponsored, endorsed, administered by, or associated with Instagram or Facebook and that Instagram or Facebook have no liability to you in relation to the Promotion. You agree to fully release Instagram and Facebook from any and all liability in relation to your participation in this Promotion. All information you provide in connection with this Promotion is to the Promoter and not to Instagram or Facebook.
To the fullest extent permitted by law, Instagram and Facebook (including its officer, employees, and agents), will not be liable in any way (including negligence) for any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising any way out of this Promotion.
If all or any part of any term and condition in these Terms and Conditions shall be declared or become unenforceable, invalid or illegal for any reason, such term or condition (or part thereof) shall be deemed severed from these Terms and Conditions to the extent of the unenforceability, invalidity or illegality and the other terms and conditions hereof shall remain in full force and effect as if the offending term or provision (or part thereof) had not been inserted herein.
These terms and conditions shall be governed by and construed in accordance with the laws of New Zealand and shall be subject to the non-exclusive jurisdiction of New Zealand courts.
The Promoter's failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that or any other provision by the Promoter.
